Definitions
- "Company"
- Ekhaya Interiors, a business registered and operating at 5 Stafford Place, Empangeni, KwaZulu-Natal, South Africa.
- "Client"
- Any individual or entity that engages the Company for design or renovation services.
- "Services"
- Interior design, furniture customization, full renovation, project management, and related consulting services.
- "Deliverables"
- Mood boards, 2D renderings, shopping lists, and any other materials produced as part of the Services.
- "Project"
- The specific scope of work agreed upon between the Company and the Client.
1.0 Acceptance of Terms
By accessing our website, requesting a quotation, or engaging our services, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our services.
1.1 Modifications
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to this page. Continued use of our services constitutes acceptance of the revised terms.
1.2 Eligibility
By using our services, you represent that you are at least 18 years of age and have the legal capacity to enter into binding contracts.
2.0 Services
Ekhaya Interiors provides interior design and renovation services as described on our website and in individual service agreements.
2.1 Scope of Work
The specific scope of each project will be detailed in a written quotation or service agreement. Any changes to the scope must be agreed upon in writing by both parties.
2.2 Exclusions
Unless explicitly agreed otherwise, our standard design packages do not include kitchen or bathroom design. Structural engineering, plumbing, and electrical work are excluded unless specified in the project agreement.
2.3 Online Services
Our online design packages are delivered remotely. The Client is responsible for providing accurate measurements, photographs, and other information requested by the Company.
3.0 Quotations
All quotations are valid for 30 days from the date of issue unless otherwise stated. Quotations are based on the information provided by the Client and are subject to change if the scope of work changes.
3.1 Site Assessment
For renovation projects, a site assessment is required before a final quotation can be provided. The assessment allows us to evaluate wall conditions, measurements, and material requirements.
3.2 Material Samples
We bring material samples to the Client during the consultation phase. Final material selection must be confirmed in writing before work commences.
4.0 Payment Terms
Payment terms are as follows:
- A 50% deposit is required to confirm booking and commence work.
- The remaining balance is due upon completion of the project or as agreed in the payment schedule.
- Late payments may incur interest at the rate of 2% per month.
- All prices are quoted in South African Rand (ZAR) and include VAT where applicable.
5.0 Intellectual Property
All designs, mood boards, renderings, and other creative materials produced by Ekhaya Interiors remain the intellectual property of the Company until full payment has been received.
5.1 Usage Rights
Upon full payment, the Client receives a non-exclusive, non-transferable license to use the Deliverables for personal, non-commercial purposes.
5.2 Portfolio Rights
The Company reserves the right to use photographs of completed projects for marketing, portfolio, and promotional purposes, unless the Client explicitly requests otherwise in writing.
6.0 Limitation of Liability
To the fullest extent permitted by law, Ekhaya Interiors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to our services.
6.1 Warranty
We warrant that our services will be performed in a professional and workmanlike manner. This warranty is limited to 90 days from the date of completion.
7.0 Termination
Either party may terminate the agreement with 14 days' written notice. In the event of termination by the Client, the deposit is non-refundable. Work completed up to the termination date will be invoiced accordingly.
8.0 General Provisions
These terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of KwaZulu-Natal.
8.1 Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
8.2 Entire Agreement
These Terms of Use, together with any written quotation or service agreement, constitute the entire agreement between the parties.
